Anti-Foreclosure Attorney Michael T. Pines Arrested While Trying To Save Clients' La Costa Home

A local attorney known for going to extreme measures to save his clients' homes was arrested on Wednesday and an exclusive video obtained by 10News reveals the threat that led to one of the attorney's arrests.

Encinitas attorney Michael T. Pines was arrested on Wednesday for violating a restraining order against him. Before he was arrested, Pines was in the process of fighting for clients who he said were illegally evicted from their La Costa home.

Wednesday's arrest was Pines' third arrest in less than a week. On Saturday, Pines was arrested when Carlsbad police said he became violent with a security guard at a La Costa home. Pines was also arrested the day before for trespassing and threatening the security guard, which was caught on video.

"I'm going to precipitate an armed confrontation … Want me to say it again? I'm going to force an armed confrontation," Pines said on the video.

Pines had this to say about the weekend arrests: "I was arrested twice because I was trying to stop them because they have absolutely no legal right to this house whatsoever."

Pines said they bought the home at an illegal auction after the bank unlawfully foreclosed on his clients.

Fighting foreclosure in bold ways is what Pines does. In October, Pines helped a family break into their foreclosed home in Escondido. The home had already been sold at auction and the family was evicted again just days later. Pines' argument is that the original mortgages were fraudulent.

Just a few years ago, Michael himself was a fraud victim of EMC Mortgage Corporation. In taking action, Michael discovered he was not alone, and the loan servicer was fined $28 million in early 2008 by the Federal Trade Commission ("FTC"). Most recently, Michael is representing homeowners and real estate investors, obtaining favorable motions in cases of predatory lending and mortgage fraud.
